Using Listing Photos the Right Way: What Agents Should Know About Photo Rights and License Transfers

Listing photos are a major part of marketing a property, but they are not always as simple as “the photos already exist, so they can be used again.”


When a property changes agents, gets re-listed, or a seller already has photos from a previous shoot, it is important to make sure the right permission is in place before those images are used again.


This is especially important if the photos were taken by another photographer, another real estate media company, a previous agent’s photographer, or even RE PIXS for a previous client.


The safest rule is simple: before using existing listing photos, make sure you have permission to use them.


Access to Photos Does Not Always Mean Permission to Use Them


A seller may have old photos saved. A previous agent may have already marketed the property. The home may still have images online from an earlier listing.


That does not automatically mean those photos can be reused by a different agent or brokerage.


Real estate photos are typically licensed for approved use. That means the person or company using the images needs to have the right permission before uploading, sharing, or reusing them.


This is especially important when a listing changes agents or when photos were originally taken by another photographer or media company.




RE PIXS Provides a License to Use the Images


When RE PIXS photographs a property, the ordering agent or brokerage receives a license to use the images for approved marketing of that property. That license allows the photos to be used for normal listing marketing needs, but it does not automatically transfer to another agent, brokerage, vendor, or third party.

A Note About Virtual Staging and Photo Edits



Photo usage rights also apply to edits.


RE PIXS cannot virtually stage, edit, or alter photos taken by another photographer unless the proper permission is provided first.


If RE PIXS took the original photos, we can help with virtual staging and other edits. If another photographer took the photos, permission needs to come from the original photographer or rights holder before we can make changes.


This helps make sure the photos are being used and edited correctly.
